1. INTRODUCTION & ACCEPTANCE OF TERMS
1.1. Governing Agreement
These Terms of Service (“Terms”) govern your access to and use of all products, content, services, websites, membership areas, and community spaces operated by Low Back Ability LLC, a New York limited liability company (“LBA,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.
1.2. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, store, and use personal information.
By using the Service, you consent to the data practices described in that policy.

1.4. License to Use the Service
Subject to your compliance with these Terms, LBA grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal use.
You may not reproduce, modify, sell, or publicly distribute LBA content without written permission.
2. AGE, ACCOUNTS & ACCESS
2.1. All Ages Allowed — But Only Adults May Create Accounts
The LBA educational content and training philosophy may be viewed and used by individuals of all ages.
However, only individuals 18 and older may:
- Create an account
- Purchase a membership
- Access Discord
- Provide personal information
- Participate in the community
For minors under 18:
- A parent or legal guardian must create and manage the account.
- The parent/guardian is fully responsible for all activity on the account.
For children under 13:
In compliance with COPPA:
- Children under 13 cannot provide personal information
- Children under 13 cannot create accounts
- Children under 13 cannot use Discord or community features
Parents may use LBA content with their child, but LBA does not knowingly collect personal data from children under 13.
2.2. Account Registration
To access subscription content, you may be required to create an account through our membership provider (Memberful).
You agree to:
- Provide accurate and complete information
- Maintain and update your information as needed
- Not share your login credentials with others
- Accept full responsibility for all activity on your account
LBA reserves the right to refuse, disable, or delete accounts at its discretion.
2.3. Login Security
You are responsible for keeping your login information confidential.
You agree to notify us immediately at support@lowbackability.com if you suspect:
- Unauthorized use of your account
- A security breach
- Loss of access to your email
We are not liable for losses or damages resulting from unauthorized account access.
3. COMMUNITY, CONDUCT & HEALTH DISCLAIMERS
3.1. General Conduct Expectations
By using the Service or participating in the community (including Discord), you agree NOT to:
- Harass, threaten, or abuse others
- Share or promote medical misinformation
- Share unsafe training instructions
- Post hateful, discriminatory, or obscene content
- Impersonate LBA staff, coaches, or members
- Share others’ personal information
- Spam, advertise, or solicit without permission
- Interfere with the functioning of the Service
Violation of these rules may result in account suspension or removal from the community.
3.2. Community Spaces (Discord, Comments, Chats)
LBA provides community spaces for support, discussion, and shared experience.
These spaces are not medical environments, and you agree to:
- Engage respectfully with other members
- Avoid giving authoritative medical advice
- Avoid diagnosing or prescribing for others
- Respect moderators and coaching staff
- Follow posted guidelines and Discord rules
LBA may moderate, but is not obligated to monitor, the community.
We may remove posts or suspend accounts at our sole discretion.
3.3. Health & Training Disclaimer
LBA provides educational content rooted in movement, physical training, biomechanics, body awareness, and lifestyle principles.
You acknowledge and agree that:
- LBA is not a medical provider.
- We do not diagnose, treat, or cure medical conditions.
- Our training methods and programs may not be appropriate for all individuals.
- Participation is entirely voluntary and done at your own risk.
- You should consult a licensed physician before beginning any exercise program.
- Any progress, improvements, or outcomes vary by individual.
By using the Service, you voluntarily assume all risks associated with exercise, movement, or physical activity.
4. PROHIBITED USES
You agree not to engage in activities that:
- Violate any applicable law
- Attempt to reverse-engineer or disrupt the Service
- Attempt unauthorized access to accounts, servers, or systems
- Interfere with site performance, security, or availability
- Upload harmful code, malware, or automated scripts
- Misuse LBA intellectual property or branding
- Reproduce, resell, or exploit LBA content without permission
LBA reserves the right to investigate and take action—including suspension or legal action—against prohibited conduct.
5. USER CONTENT
5.1. User Content Definition
“User Content” includes any content you submit, upload, post, share, or otherwise transmit through the Service or community spaces, including:
- Messages
- Comments
- Images or media
- Posts in Discord
- Feedback, suggestions, or ideas
- Any information shared publicly
You remain the owner of your User Content.
5.2. Your Responsibilities
By submitting User Content, you agree and confirm that:
- You own the rights to the content or have permission to use it
- Your content does not violate any laws or third-party rights
- Your content does not contain harmful code
- You understand LBA is not responsible for how other users may use or interpret your content
You are solely responsible for your interactions and the content you choose to share.
5.3. LBA’s Rights to User Content
By posting or submitting User Content, you grant Low Back Ability LLC a:
Worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to:
- Use
- Reproduce
- Display
- Publish
- Modify
- Adapt
- Distribute
- Create derivative works
- Promote and market the Service
This is solely for purposes related to operating, improving, or showcasing the Service, including community education and marketing.
LBA will never sell your User Content or misrepresent it.
5.4. Public Spaces & Indexing
Some User Content (such as your name or profile image, depending on platform settings) may be visible to other users and potentially indexed by search engines.
Do not share information you want to remain private.
6. COMMUNITY INTERACTIONS
6.1. Discord & Community Areas
LBA hosts community interactions in:
- Discord
- Comments sections
- Live events
- Member forums
These spaces exist for mutual support, shared experience, and education—not medical advice.
LBA does not guarantee that all posts are accurate, appropriate, or safe. Participation is voluntary.
6.2. Moderation
We may moderate but are not required to monitor all interactions.
We may:
- Remove content
- Restrict posting
- Suspend or ban accounts
- Limit access to community areas
…if content violates our rules or poses risk to other members.
6.3. Member Disputes
You are solely responsible for your interactions with other members.
If disputes arise, you agree to release LBA from all claims related to those interactions.
7. INTELLECTUAL PROPERTY
7.1. Ownership of LBA Content
All content and materials provided through the Service—including:
- Videos
- Lessons
- Courses
- Written content
- Graphics
- Branding
- Logos
- PDFs
- Training programs
- Website structure
- Community resources
…are the exclusive intellectual property of Low Back Ability LLC.
7.2. Restrictions
You may not:
- Copy or distribute LBA content
- Resell or sublicense access
- Re-upload materials elsewhere
- Use content for commercial purposes
- Alter or create derivative works without permission
7.3. Account Ownership
Membership accounts are the property of LBA.
We may deactivate or delete accounts in accordance with our policies.
8. SUSPENSION, TERMINATION & CANCELLATION
8.1. When LBA May Suspend or Terminate Accounts
We may suspend, restrict, or terminate accounts at our sole discretion, including for:
- Violations of these Terms
- Illegal or harmful behavior
- Abuse of community guidelines
- Payment failures
- Fraudulent or unauthorized use
- Security risks
- Requests from law enforcement
Termination may include:
- Loss of account access
- Loss of membership content
- Loss of Discord access
- Removal of posted content
Refunds are not provided in cases of termination related to violations of Terms.
8.2. Your Right to Cancel
You may cancel your membership at any time. To cancel:
- Go to lowbackability.com
- Sign in using the “Enter LBA” or “Sign In” button
- Click Account Management
- On mobile, open the top-right menu and select Cancel Subscription
After cancellation:
- No future charges will occur
- Access continues until the end of your current billing period
- You will receive a confirmation email
8.3. Automatic Renewal
Memberships renew automatically unless canceled before the next billing date.
LBA does not provide refunds for:
- Partial subscription periods
- Retroactive cancellation
- Forgetting to cancel
Except when required by law or granted at LBA’s discretion.
9. PURCHASES, BILLING & SUBSCRIPTIONS
9.1. General Purchase Terms
When purchasing any membership, product, or service through Low Back Ability LLC:
- You must provide accurate, complete payment information
- You authorize LBA and its payment processors (e.g., Stripe, Memberful) to charge your chosen payment method
- You agree to pay all fees incurred under your account
All membership payments are processed securely by third-party processors.
LBA does not store credit card numbers.
9.2. “Pay What You Want” Pricing
LBA operates on a Pay-What-You-Want membership model, where members may choose their monthly contribution amount.
Pricing flexibility does not affect:
- Access level
- Billing terms
- Cancellation terms
All submit-and-confirm payments are final.
9.3. Subscription Renewals
Memberships renew automatically on a monthly or yearly basis, depending on your selection.
By subscribing, you agree that:
- Charges will continue unless you cancel
- The renewal amount will be the amount you selected at checkout
- You are responsible for canceling before the next billing date
Declined payments may result in temporary suspension of access.
9.4. Taxes
Sales or use taxes may be applied based on your location.
You are responsible for any required tax filings for your jurisdiction.
10. REFUND POLICY
10.1. Standard Refund Policy
LBA provides full, immediate access to digital materials, training programs, and community resources upon signup.
Therefore:
Refunds are not typically provided.
10.2. How to Request a Refund

10.3. Case-by-Case Review
Low Back Ability LLC may issue refunds at its sole discretion in circumstances it deems appropriate.

- Exceptional circumstances warrant consideration
10.4. Non-Refundable Scenarios
We do not provide:
- Partial refunds
- Pro-rated refunds
- Retroactive refunds for past months
- Refunds due to failure to cancel on time
- Refunds after long periods of non-use
Unless required by law.
11. THIRD-PARTY SERVICES & INTEGRATIONS
LBA uses third-party tools to deliver its service, including but not limited to:
- Memberful (Membership & Account Management)
- Stripe (Payments)
- Discord (Community Hosting)
- WordPress (Website Platform)
- Jetpack (Performance, Forms & Security)
- Google Analytics / Site Kit (Website Analytics)
- LearnDash (Course Delivery)
- Shopify (Merchandise Sales, if applicable)**
These services operate under their own privacy policies and terms.
11.1. No Responsibility for Third-Party Platforms
LBA is not responsible for:
- Outages caused by third-party tools
- Security incidents arising from third-party platforms
- Data handling practices of third-party providers
- Loss of access due to third-party service downtime
Your use of these platforms is at your own discretion.

LBA does not endorse or take responsibility for:

12. SERVICE AVAILABILITY & TECHNOLOGY DISCLAIMERS
12.1. No Guarantee of Uninterrupted Service
You understand and agree that:

- Access may be temporarily unavailable due to maintenance, updates, or outages
- Third-party platforms may disrupt service access
LBA does not guarantee uninterrupted or error-free performance.
12.2. Technical Requirements
You are responsible for:
- Stable internet access
- A compatible device
- Updating software as needed
LBA is not responsible for inability to access the Service caused by your device, network, or browser issues.
12.3. Data & Platform Changes
LBA may update, modify, or remove features or content without prior notice.
We may also update our platform integrations or discontinue certain services based on operational needs.
13. DISCLAIMERS
13.1. General Disclaimer
YOU USE THE SERVICE AT YOUR OWN RISK.
The Service—including all programs, videos, written materials, tools, community spaces, and coaching communication—is provided “AS IS” and without warranties of any kind, whether express or implied.
LBA DISCLAIMS ALL WARRANTIES, INCLUDING:
- Fitness for a particular purpose
- Accuracy or completeness of content
- Non-infringement
- Availability or reliability of the Service
- Results or outcomes
We do not guarantee:
- That the Service will be uninterrupted or error-free
- That technical issues will be resolved immediately
- That content is appropriate for all individuals
- That outcomes or progress will occur
13.2. Health & Training Disclaimer
The Service provides educational and training content related to physical movement, strength building, and back health concepts.
We are not a medical provider.
Nothing in the Service should be interpreted as:
- Medical advice
- Physical therapy
- Diagnosis
- Prescription
- Treatment
- A substitute for professional medical evaluation
You acknowledge:

LBA is not liable for injuries, flare-ups, conditions, or complications arising from the use or misuse of the Service.
14. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOW BACK ABILITY LLC AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Indirect or consequential damages
- Loss of profits
- Loss of data
- Personal injury or health complications
- Downtime or service interruptions
- Errors or omissions
- Actions of other users
- Decisions based on community advice
Maximum Liability
IN ANY EVENT, LBA’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO LBA IN THE 180 DAYS PRIOR TO THE CLAIM.
Some states do not allow limitations of liability; in such cases, the limitation applies to the maximum extent permitted by law.
15. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Low Back Ability LLC from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising from:
- Your use or misuse of the Service
- Violation of these Terms
- Your interactions with other users
- Your participation in training, movement, or physical activities
- User Content you post
- Your breach of representations or warranties
LBA reserves the right to assume exclusive defense and control of matters subject to indemnification.
16. DISPUTE RESOLUTION
16.1. Good Faith Resolution First
Before initiating formal dispute proceedings, you agree to contact us at support@lowbackability.com to attempt to resolve the issue informally.
16.2. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict-of-law rules.
16.3. Exclusive Venue
Any legal actions or proceedings shall be brought exclusively in:
- State courts of New York County, New York, or
- Federal courts in the Southern District of New York
You consent to the jurisdiction and venue of these courts.
16.4. Arbitration Option
Upon mutual agreement, we may choose to resolve disputes through binding arbitration with a mutually agreed-upon ADR provider.
Arbitration decisions are final and enforceable in court.
17. INTERNATIONAL USERS
LBA operates in the United States.
If you access the Service from outside the U.S.:
- You consent to the processing of your data in the U.S.
- You agree to comply with local laws applicable to you
- You understand that U.S. data protection laws may differ from those in your country
You are responsible for ensuring the Service is legal where you reside.
17. SEVERABILITY
If any part of these Terms is found to be unlawful, invalid, or unenforceable, that portion will be modified or removed to the minimum extent necessary, and the rest of the Terms will continue in full force.
18. ASSIGNMENT
Low Back Ability LLC may assign or delegate its rights under these Terms to any affiliate, successor entity, or purchaser of assets without your consent.
You may not transfer or assign your rights or obligations under these Terms without our written approval. Any unauthorized assignment is void.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies explicitly referenced, constitute the entire agreement between you and Low Back Ability LLC regarding your use of the Service.
This supersedes all prior written or verbal agreements concerning the Service.
20. NO WAIVER
If LBA does not enforce a right or provision in these Terms, it is not a waiver of that right.
A waiver is only legally binding if it is in a written statement signed by Low Back Ability LLC.
